**The following is a small list of ordinances enforced on a day to day basis.**

ORDINANCE 1990-9/2005-10

AN ORDINANCE PROHIBITING THE PARKING OF UNLICENSED VEHICLES ON THE PUBLIC RIGHT OF WAY AND PROHIBITING THE STORAGE OF UNLICENSED OR DAMAGED VEHICLES IN PUBLIC VIEW

No vehicle, as defined by Indiana Code 9-13-2-196, which does not have issued to it and on display, a current license plate issued by State of the United States, or an agency of government, shall be parked or allowed to set upon any public right-of-way in the City of Boonville.

No vehicle, as defined by Indiana Code 9-13-2-196, which is damaged so as to render it non-functional or which does not have issued to it and on display a current license plate issued by a State of United States, or any agency of Government, shall be stored or left setting on private property if such vehicle my be seen by the public from a public right-of-way.

(A)     Owners of Recreation/Competition vehicles such as demolition cars, race cars, mud bogging trucks etc…stored on private property and visible to the public from a public right-of-way must keep vehicle cover over the vehicle.

Violation of this ordinance may be the subject of a suit for injunction to enforce the same, a fine of twenty-five dollars ($25.00) for each day of violation, or both.

ORDINANCE 1995-8

AN ORDINANCE FOR THE REMOVAL AND DISPOSAL OF ABANDONED VEHICLES

Abandon vehicle- Vehicle parts and/or a vehicle that is mechanically inoperable and is left on private property continuously in a location visible from public property for more than thirty (30) days.  Vehicle parts and/or a vehicle that is covered by a tarpaulin, canvas, plastic, etc., shall still be visible pursuant to this ordinance unless said covering is custom to made to fit vehicle.

Responsibility of the Owner- The owner of an abandoned vehicle or parts is responsible for the abandonment and is liable, to the extent of the market value of the vehicle, for all costs incidental to the removal, storage and disposal of the vehicle or parts.

ORDINANCE 1995-3/2002-10/2004-18 & 19

Ordinance for the removal of weed and rank vegetation & Modification of City of Boonville Ordinance 1995-3, Grass and weeds

The penalties for a violation of this ordinance in addition to the recovery of costs including attorney fees is twenty-five dollars ($25.00) for the first violation, fifty dollars ($50.00) for the second violation and one hundred dollars ($100.00) for the third violation and each subsequent violation.

No owner of real property shall allow any growth of weeds in excess of 8 inches in height upon his property.

When grass and/or weeds are removed by action of the department or its contractor the owners of record at the time the Notice to Remove Grass and/or Weeds was sent jointly and severally liable for the cost of removal.  The costs of typical grass and/or weed removal by the City will be one hundred dollars ($100.00) whether the City has to mow or trim any portion of any property, premises, lot or sidewalk within the City of Boonville.

ORDINANCE 1997-15/2006-08

SOLID WASTE ORDINANCE

No owner, occupant, tenant or lessee of any building, structure, property, or premises in the City shall store, collect, transport or dispose of any refuse, garbage, rubbish or other rejected, unwanted or discharged waste materials, except in compliance with this ordinance and applicable State, Federal and local laws, rules and regulations.

Bulky Waste - Bicycle parts, lawn mower parts, vehicle parts and farm implements. Household wastes such as stoves, refrigerators, water tanks, washing machines, furniture, toilets and any other matter of this nature.

Penalties- The penalty for a violation of sections two (2) through and including section twenty-two (22) shall be $50.00 for the first violation and $150.00 for each and every subsequent violation plus any applicable costs, including reasonable attorney fees.
